1. Acceptance of Terms
By registering for an account with SPM or by accessing or using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.
We reserve the right to modify these Terms at any time. Material changes will be notified to you via email or a prominent notice on our website. Your continued use of our services after such notification constitutes acceptance of the updated Terms.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction, if higher).
- Have the legal capacity to enter into binding contracts.
- Not be a resident of, or located in, any jurisdiction where the use of our services is prohibited by applicable law.
- Not be on any sanctions lists or politically exposed persons (PEP) lists without prior disclosure and approval.
By using our services, you represent and warrant that you meet all eligibility requirements.
3. Account Registration & Security
- You must provide accurate, complete, and current information during registration and keep this information updated.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must not share your account credentials with any third party, or allow any unauthorised person to access your account.
- You must notify us immediately if you suspect any unauthorised access to or use of your account.
- SPM reserves the right to suspend or terminate accounts where suspicious activity is detected or where Terms are violated.
4. Know Your Customer (KYC) & Verification
In compliance with applicable Anti-Money Laundering (AML) and financial regulation, you are required to complete identity verification before making deposits, withdrawals, or trading. This includes:
- Providing a valid government-issued photo identification document.
- Providing proof of residential address (dated within 3 months).
- Completing source of funds declarations as required.
- Providing any additional documentation requested by our compliance team.
We reserve the right to restrict account functionality until verification is complete, and to terminate accounts where verification cannot be completed satisfactorily.
5. Trading Services
SPM provides access to online trading in financial instruments including Forex, CFDs on indices, commodities, stocks, and cryptocurrencies. You acknowledge that:
- Trading in financial instruments involves a high degree of risk and may not be suitable for all investors.
- You may lose all or more than your initial investment when trading leveraged instruments.
- Past performance is not a reliable indicator of future results.
- SPM does not provide financial, investment, legal, or tax advice. All trading decisions are made solely by you.
- Market prices are obtained from third-party providers and may differ from other sources.
6. Deposits & Withdrawals
- All deposits must originate from a payment method registered in your own name. Third-party deposits are not accepted.
- Withdrawal requests will be processed to the original payment method used for deposit where possible.
- We reserve the right to conduct additional verification checks before processing withdrawals.
- SPM is not responsible for delays caused by third-party payment providers, banks, or network congestion.
- Minimum and maximum deposit/withdrawal amounts vary by payment method and are displayed on the platform.
7. Fees & Charges
By using our services, you agree to pay all applicable fees as set out on our platform, including but not limited to:
- Trading commissions (where applicable based on account type).
- Overnight financing charges (swap rates) for positions held past the daily rollover time.
- Inactivity fees for accounts with no trading activity for an extended period.
- Payment processing fees charged by third-party providers.
All fees are disclosed on our platform and may be updated with reasonable notice.
8. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the platform for money laundering, fraud, or any other illegal purpose.
- Attempting to manipulate markets, execute trades exploiting platform errors, or engaging in arbitrage strategies that abuse our pricing.
- Using automated bots, scripts, or other tools to access our platform in ways that violate these Terms.
- Providing false or misleading information during account registration or verification.
- Engaging in any activity that could damage, disable, or impair the proper functioning of our platform.
- Attempting to gain unauthorised access to any portion of our systems or services.
9. Intellectual Property
All content on the SPM platform — including text, graphics, logos, images, software, and data — is the exclusive property of SPM or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any platform content without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- SPM shall not be liable for any trading losses, loss of profit, or any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services.
- Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you to SPM in the twelve (12) months preceding the claim.
- We are not liable for losses arising from events beyond our reasonable control, including market events, regulatory changes, technical failures of third-party infrastructure, or force majeure events.
11. Indemnification
You agree to indemnify, defend, and hold harmless SPM, its directors, officers, employees, agents, and service providers from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to our platform.
12. Termination
SPM reserves the right to suspend or terminate your access to our services at any time, with or without cause and with or without notice, including where we believe you have violated these Terms. Upon termination:
- All open positions may be closed at the prevailing market price.
- Any funds remaining in your account (less any outstanding charges) will be returned to you, subject to completion of applicable verification requirements.
- Provisions of these Terms that by their nature should survive termination shall continue to apply.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SPM is licensed and incorporated, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts of the applicable jurisdiction.
